These Terms of Service govern your use of the Ontario Eviction Services website, our communications, and any paralegal services we provide. By using this website or engaging us, you agree to these terms.
Ontario Eviction Services is a paralegal practice authorized to provide legal services in the Province of Ontario in accordance with the rules of the Law Society of Ontario. Our services are limited to matters within the scope of practice for licensed paralegals in Ontario, including representation at the Landlord and Tenant Board and Small Claims Court.
The specific services we will provide for any given matter are documented in a written engagement letter signed by both you and our office. Until that engagement letter is signed, no solicitor-client relationship exists. Inquiries through this website, phone, or email do not create such a relationship.
Information on this website is provided for general information only. It is not legal advice and should not be relied on as such. Every situation is different. To obtain advice on your specific circumstances, you must engage us under a written engagement letter.
Fees are disclosed in advance in your engagement letter. We may charge fixed fees, hourly fees, or a combination depending on the matter. Disbursements (e.g., LTB filing fees, court fees, sheriff fees, courier costs) are passed through at cost. Fees are payable in Canadian dollars unless otherwise agreed.
You agree to provide complete and accurate information, respond to communications in a timely manner, and follow our guidance regarding statutory notice periods, hearing dates, and filing deadlines. Failure to do so may compromise your matter and we cannot be held responsible for outcomes that result from missed deadlines outside our control.
We treat all client information as confidential in accordance with the Law Society of Ontario's Paralegal Rules of Conduct. See our Privacy Policy for more detail on how personal information is handled.
Either party may terminate the engagement at any time, in writing. On termination, you will be billed for services provided up to the date of termination. We will return your file to you or transfer it to your new representative.
To the maximum extent permitted by law, our liability for any claim arising from or related to our services or the content of this website is limited to the fees actually paid by you to us in respect of the matter giving rise to the claim. We are not liable for indirect, special, incidental, or consequential damages.
All website content, branding, and materials are owned by Ontario Eviction Services or licensed for our use. You may not reproduce, redistribute, or commercially exploit our content without our prior written permission.
Our website may link to third-party sites. We do not control or endorse third-party content and we are not responsible for it.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute arising under these terms will be heard in the courts of Ontario, sitting in the Toronto Region. Both parties consent to the exclusive jurisdiction of those courts.
Before commencing any court action, the parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, either party may pursue the matter through the Ontario courts as set out above. Nothing in this section prevents a party from seeking injunctive relief or pursuing remedies before the Law Society of Ontario where applicable.
If any provision of these terms is held invalid, the remaining provisions continue in full force and effect.
We may update these terms from time to time. Continued use of the website or our services after an update constitutes acceptance of the revised terms.
